THARPE & HOWELL SAVES FIRM CLIENT OVER $400,000 IN COMPLEX INSURANCE LITIGATION


Tharpe & Howell won a Motion for Summary Judgment in a very complex insurance litigation case which saved the firm's client over $400,000. The Motion proved that a loss payee of a fire insurance policy has no right to policy proceeds where the value of the insured property exceeds the amount of the mortgage loans as of the date of a fire loss. Since the loss payee's interests remained secured by the value of the land, it had no right to any of the insurance proceeds after the fire loss.
