HOME RUN HIT FOR CAR DEALERSHIP CLIENT!
Attorney Chet Glover of the Firm's Las Vegas office recently hit a home run for a car dealership client when he won a Motion for Summary Judgment he had filed on the client's behalf! In this case, the Firm's Nevada Ford Dealership client was sued for products liability. Attorney Glover served a modest Offer of Compromise on plaintiff early-on, to lock plaintiff into the payment of our client's defense if a better result was not obtained by the plaintiff at the conclusion of the case. The Offer was not accepted by the plaintiff and automatically expired by operation of law. After the case had been on-going for almost a year, Attorney Glover filed a Motion for Summary Judgment on behalf of the car dealership client, which was granted by the Court. In its decision, the Court noted there was no evidence of a product defect in relation to the accident and that plaintiff's medical records demonstrated there was another cause for the accident. Namely, plaintiff had suffered from dizzy spells prior to the accident and had even admitted that the dizziness played a part in the accident. After hearing oral argument from both sides, the Court granted the Motion for Summary Judgment on our client's behalf! Because plaintiff failed to accept the modest Offer served in the case early-on, attorney Glover will now ask the Court for an Order requiring plaintiff to reimburse the dealership for over $15,000 in fees and costs incurred.
