SUPREME COURT RULES ON WAGE/REST PERIOD VIOLATION STATUTE


The California Supreme Court issued a decision in Murphy v. Kenneth Cole on April 16, 2007 finding that the remedy provided for in Labor Code Section 226.7 (which requires employers to pay employees an additional hour for meal and rest period violations) is a "wage" subject to a 3 year statute of limitations rather than a "penalty" subject to a 1 year statute of limitations.
