COURT OF APPEALS AFFIRMS GRANTING OF MOTION FOR SUMMARY JUDGMENT
The California Court of Appeals affirmed the granting of a Motion for Summary Judgment for one of the Firm's restaurant clients in a food borne illness case. James Eiler and Paul Burke of the Firm's Hospitality Law Practice Group argued that the restaurant was not responsible for causing emotional distress to a vegan when the food she was served contained some meat products. The court ruled that the restaurant did not owe a duty to the plaintiff "to protect [plaintiffs] emotional tranquility." And, as there was no evidence of a physical injury, the court ruled that the granting of the Motion for Summary Judgment was proper.
