FIRM OBTAINS DEFENSE VERDICT IN TRIP-AND-FALL CASE!
Litigator Jeff Hinrichsen of the Firm's Sacramento office was recently awarded a complete defense verdict in favor of a carpet installation company client!
In this case plaintiff, who was 7 months pregnant, fell at an apartment complex when her heel caught in an area of depressed carpet that was caused by hole in the sub-floor beneath. The Firm client was a carpet installation company that allegedly had installed the carpeting over the hole.
As a result of the fall, plaintiff suffered a right patellar dislocation and bone fragments in her left knee which required surgery. She also developed an altered gait which caused back neck and lower extremity symptoms. Additionally, she claimed extreme emotional distress secondary to concern for her unborn child.
Prior to trial, plaintiff's demand was $500,000. On behalf of the carpet installation company client, the Firm offered $1,500.00.
Issues included whether or not the Firm's client had actually installed the carpet (it had performed over 200 other jobs at the complex). Secondary issues were comparative fault and the nature and extent of plaintiff's injuries.
The jury was out for only 85 minutes - before returning a verdict in favor of the defense!
