FIRM WINS DEFENSE VERDICT IN WRONGFUL DEATH/PRODUCTS DEFECT CASE
Firm Partner Robert Cardwell recently obtained a defense verdict on behalf of a commercial equipment leasing client in a wrongful death/products defect lawsuit venued out of Clark County District Court, Nevada.
In this large-exposure case, the Firm's client, a commercial equipment leasing company, had leased a utility trailer to a customer for towing behind a GMC Jimmy SUV. Thereafter, the customer used the trailer without incident on two separate occasions. On the third occasion, however, the customer loaded the trailer with gravel and, while attempting to pull the heavy, unbalanced load, the trailer jack-knifed and caused the Jimmy to veer out of control. As a result, the vehicle rolled and caught on fire - causing the client's customer to be instantly killed.
Following the accident, the decedent's wife and two children brought suit against the Firm's commercial equipment leasing client, claiming that the trailer was defective and that proper warnings had not been provided by the client at the time of leasing.
Significant offers were made by the defense without admission of liability prior to trial - but were rejected by plaintiffs out-of-hand. The case proceeded to trial and, after hearing argument for 8 days, the jury agreed with litigator Cardwell, found that the trailer was not defective, and rendered a verdict in favor of the defense.
