CONSUMER CLASS CERTIFICATION DENIED!
The Firm successfully opposed a motion for class certification in a consumer class action based on Business & Professions Code Section 17200. In this case, plaintiffs alleged the Firm's client, the defendant RV dealership, misled customers into purchasing after-market options like service contracts and gap insurance. The putative class had the potential to include thousands of customers, exposing the dealership to millions in restitution and attorney's fees. On behalf of its dealership client, the Firm's opposition attacked plaintiffs' survey evidence and declarations from putative class members and effectively distinguished the case from the California Supreme Court's pro-class decision in In Re Tobacco II Cases which was filed days before the opposition was due.
