FIRM ATTORNEYS SUCCESSFUL IN OBTAINING WRIT RELIEF!
Senior Partner Chris Maile and Senior Associate Eric Kunkel have succeeded in blocking the production of protected information in a personal injury case. In this action, the opposing party demanded the production of information protected by the doctor-patient privilege and the right of privacy, and information protected by the attorney work-product privilege. When the Trial Court ordered the production of the privileged information after hearing a motion to compel, the Firm timely sought relief.
Attorneys Maile and Kunkel brought a petition for writ of mandate in the Court of Appeal which challenged the Trial Court's decision. In response, the Court of Appeal indicated it is considering the issuance of a peremptory writ in the first instance to overturn the ruling by the Trial Court. Less than 5% of all petitions for such extraordinary relief are granted.
