DAVID BINDER is a Senior Associate of the Firm in the Sherman Oaks office. Mr. Binder's experience includes:

  • Working in the Firm's Labor and Employment Practices Group representing management in all aspects of employment law including wrongful discharge, discrimination, harassment, retaliation, wage and hour claims, whistle blower, breach of contract, defamation, fraud, and unfair competition.


  • Representing employers before state and federal administrative agencies including the Department of Fair Employment and Housing, U.S. Equal Employment Opportunity Commission, Division of Labor Standards Enforcement, Cal OSHA, and the Workers' Compensation Appeals Board.


  • Providing advice and counsel to employers in all aspects of the employer-employee relationship including policies, discipline, compensation, reductions in force, alternative workweek arrangements, individual employee terminations, disability accommodation matters, FMLA and CFRA, and negotiating severance and resignation agreements, auditing employer operations to ensure compliance with state and federal laws, and developing and implementing employee and management training programs.


  • Areas of practice also include defending claims brought under Title III of the Americans with Disabilities Act/California Disabled Persons Act and business litigation.


  • Clients include insurance companies, transportation companies, restaurants, and hotels.

Recent matters that Mr. Binder has handled include:

  • Obtaining a voluntary dismissal ("walk-away") of a Title III ADA claim brought against a hotel client.


  • Obtaining a voluntary dismissal ("walk-away") of a wage and hour class action lawsuit brought against a restaurant client.


  • Having motions for summary judgment granted the last three matters defended on behalf of an insurance carrier client.


  • Resolving a multi-million dollar abatement demand by Cal OSHA for less than 1% of the abatement cost.


  • Resolving a wage and hour class action lawsuit with a class of over 100 persons for substantially less than the cost of defense.
